Choosing a lawyer is never easy; especially when during a family law-related issue. Divorce and custody litigation can be one of the most traumatic experiences in one’s life.
All parties are emotional and many times clients are good people at the worst time in their lives. Family law lawyers (at least the good ones) must wear many hats. Not only must we be zealous advocates for our clients, but we must also be partial therapists, support system, and independent observers who can offer objective solutions and see beyond the conflict that our clients may not be able to see just yet.
When interviewing a lawyer, it is helpful to know what type of client you are and what your expectations are. Usually, you can get a good feel for a lawyer after the first meeting. If not, ask for a follow-up consultation.
Do you need hand-holding and support? If so, it is best to get a lawyer who will be sensitive to these needs. He or she must have the patience to explain things (possibly more than once) and be willing and have the time to walk you through the process step by step.
Are you more of a Type A personality? Do you want to be involved in the strategy and litigation process? If so, you will need to find a lawyer who does not mind you being “hands-on” and asking questions each step of the way. Your lawyer will need to include you in all decisions and seek your approval or input on all issues. While lawyers should always include their clients when making decisions, some lawyers like to lead and tell their clients what should be done instead of asking.
Finally, do you wear your heart on your sleeve? Is it difficult for you to manage your emotions and make decisions during this very difficult time in your life? If so, you will need a lawyer who is sensitive to your feelings and can help you get out of your head and see the big picture. You will need a lawyer who doesn’t mind doling out a bit of therapy along with their legal advice and patiently waiting until you are ready to take the steps needed to get you through the divorce.
Hiring a divorce lawyer is like entering into a marriage with someone who will hopefully be there, when the going gets rough and see it through until the end. Knowing what qualities, you need in a lawyer is very important and it is helpful to meet more than one. Concentrate on the lawyer and his or her attributes and don’t be dazzled by the Armani suit and fancy office because all that glitters isn’t always gold.
